Respected Madam,

            This is regarding grant of ACP and MACP schemes to officers of IP/ASP cadre.
            I would like to request your kind attention to the stands taken by the Department of Posts in this regard and the same being questioned by various CATs through the applications moved by the affected officers.  Let me put up before your kind self one such case which needs consideration of Hon. CPMG to grant the benefits fairly admissible to the IP/ASPs of this circle.
            ACP-II and MACP-III were not granted to IP/ASPs by Karnataka circle to those who passed IP examination after getting the TBOP promotion and joined IP cadre on or after 01.01.1996 on the ground that upgradation under TBOP is one financial upgradation under ACP and promotion to IP cadre with pay scale of 5500-9000 is another financial upgradation under ACP.  The officers who were promoted to TBOP and then subsequently joined the IP cadre up to the year 1998 were having identical scales for TBOP/IP.  On promotion to IP no fixation was given in the scale of pay of 1400-2300.  Subsequently under V CPC revised the scale to 4500-7000 applicable both to IPs and TBOP.  After some time scale of IPs was further upgraded to Rs. 5500-9000 as it involves higher responsibilities.  As per the clarification No. 32 of the erstwhile ACP orders the upgradation of pay scale as a whole in cadre should not be taken as individual upgradation.  As such CAT Chennai and CAT Bangalore have up held the stand and directed the department to grant the ACP-II promotion to IPs who entered IP cadre after getting TBOP and whose pay was initially fixed in the pay scale of Rs. 1400-2300 without any fixation benefit.  There are only 4 –5 cases in the Karnataka Circle apart from one Sri.Basanna Sonth,(ASP) PM Gulbarga HO in whose case CAT Bangalore under OA No. 439/2009 dated 15.4.2011 has directed the Department to grant II ACP.  In the said order it is stated no discrimination should be made to the Inspector Posts, who have not joined the cadre prior to 01.01.1996 as it would be artificial distinction.  In the said order it is also stated that the order is not personam but it is in rem.  I would request your kind self to kindly appreciate the contention of the CAT order and award benefits due to the IP/ASPs of Karnataka circle as and when they approach your kind honour for grant of ACP-II which was earlier denied to them as explained above.  For the act of kindness and judicious grant of admissible benefits to the members, I and my association shall be grateful to you madam.
