Govt employees can travel first class from April 1

Govt employees can travel first class from April 1

With signs of economic revival becoming more pronounced, the government has relaxed the austerity drive undertaken last year and from April 1, government employees will be allowed to fly first class.

"The matter has been reviewed and it has been decided that with effect from April 1, 2010, travel on government account by air, both domestic and international may take place by the entitled class," an official statement said.

Last September, in the midst of the global financial crisis, the government had directed its employees not to fly first class on government account, irrespective of their entitlement, and fly economy for all domestic travels.

However, the government has not relaxed the austerity directive in case of Leave Travel Concession (LTC).

"...austerity measures will remain in place for travel by air (where admissible) on LTC, which would continue to be restricted to economy class irrespective of the entitlement," the Finance Ministry statement said.

The Indian economy slowed down in 2008-09 after being hit by the global financial crisis triggered by the collapse of US investment bank Lehman Brothers and other Wall Street titans beginning September 2008.

The country grew at a subdued rate of 6.7 per cent in 2008-09 after growing at around 9 per cent per annum for the preceding three financial years. In 2009-10, the economy is projected to grow by 7.2 per cent and by 8.5 per cent in 2010-11.

GOVERNMENT CLARIFIES TO DENY UPGRADED PAY SCALE FOR REVISION OF PENSION

Department of Pension and Pensioners' Welfare reiterates its earlier orders to deny
revision of pension for Pre-2006 Pensioners if pay scale of any cadre was upgraded
by 6th CPC w.e.f. 1.1.2006

As per the Para 4.2 of the Department of Pension and Pensioners' Welfare OM Dated 1.9.2008 the minimum revised pension payable shall not be lower 50% of the minimum of pay in Pay Band and Grade Pay corresponding to pre-revised scale of pay from which the pensioner retired. The Government has taken the position that If the scale of the pay of the same cadre from which the pensioner retired was upgraded by the 6th CPC, then this upgraded pay will not be taken into account for calculating revision of minimum pension. It is once again clarified by the undermentioned OM that they will be granted revision of pension only on the basis of the pre-revised scale of pay in which the pensioner retired.

Clarification order regarding fixation of pay relating to Assistants.

In response to clarification sought by Ministry of Petroleum and Natural Gas, DOPT has issued this clarification order regarding fixation of pay relating to Assistants.
In brief, it is clarified by DOPT that in the cases of upgradation of posts as a result of 6CPC recommendations the fitment table attached with O.M.No: 1/1/2008-IC dated 30.08.2008, corresponding to the pre-revised scale is to be used for the purpose of determination of revised pay in the pay band. To the pay in the pay band determined the grade pay corresponding to to the upgraded post is to be added. Accordingly the revised pay of Assistants/PAs as on 1.1.2006 is to be fixed using the fitment table for the pre-revised scale of Rs.5500-9000 and the pay in the pay band so determined, grade pay of Rs.4600 is to be added.
It is also clarified by DOPT that in the case of Assistants/PAs who are promoted after 1.1.2006 and who have opted to switch over to the revised pay structure w.e.f the date of their promotion as Assistant/PA, their pay will be fixed with reference to the fitment table of the corresponding to the pre-revised scale of Rs.7450-11500. However, they shall not be entitled to any arrears of pay w.e.f 1.1.2006 till the date of their option.

CAT Madras holds the Group B examination held in 2008 as defective, arbitrary, irrational and discriminatory

Normally, any departmental examination for promotion is held every year depending upon year-wise vacancies so that the eligible candidate for a particular year vacancy would get opportunity to get selection for subsequent year vacancies. But disregarding all principles, the department conducted Group B examination by bunching of vacancies for four years viz. 2003, 2004, 2005 and 2006. Our Association objected to it. But the Department did not heed. Some of IP/ASP filed cases before CAT Madras and CAT Patna and prayed for a stay order. The honourable CATs at that time rejected to pass stay order. Though the single selection for all the four years is prejudicial to majority of the eligible candidates the Department successfully conducted the examination. With a result many juniors who were not at all eligible for the vacancies of 2004, 2005 and 2006 were allowed to appear, got selected and promoted. Now many ineligible candidates are working as PS Group B officer. The CAT Madras passed an order in OA 64/08 and some of the relevant paragraphs are reproduced below:

“ 15. If the selection for promotion is based every year separately for 2003, 2004, 2005 and 2006, depending upon year-wise vacancies, the eligible candidate for 2003 who did not get selection for the year vacancies, would get opportunity to seek selection for subsequent year vacancies and because of bunching of vacancies for all the four years and holding single selection is prejudicial to majority of the eligible candidate and such selection is detrimental to the eligible employees for whose purpose it has been intended. The respondents have not placed any instruction of guidelines in support their claim for holding the single selection by bunching of vacancies for 4 years or several years.

16. In view of such circumstances as discussed above, the decision to bunch the vacancies for all the four years together and holding a simple selection is discriminatory, arbitrary, unfair and also amounts to defect the selection.

17. In spite of objections raised by the applicants by way of representations an also by filing of this OA, the authorities have not taken any care and proceeded further in conducting examinations. The authorities have completed most of the selection procedure in conducting examination and also declared the result of the successful candidates in the written test.

18. In view of such circumstances, if this selection is restricted for the vacancies for the year 2003, no harm would be caused to any of the eligible candidates who faced the examination and selection for the year 2003 is held valid and the selection for the vacancies for 2004, 2005 and 2006 are held to be defective, arbitrary, irrational and discriminatory. Thus the claim of the applicants is allowed partly, directing the respondents to secure year-wise vacancies for the years 2004, 2005 and 2006 in respect of promotion to the cadre of Postal Services Group B by preparing year-wise list of eligible candidates and also vacancies and thereafter hold fresh Limited Departmental Competitive Examination (LDCE), restricting the present selection only for the year 2003.

19. In the result, the OA is partly allowed as above, with no order as to costs.”

Note:
What is the use of this order? The Department has deliberately conducted this examination. No relief was given by the CAT to affected candidates at that time. Selected candidates have now promoted and working in the higher posts. Justice is supposed to be delivered in time.

Core banking services at post offices

There is a proposal to introduce Core Banking Solution (CBS) in 4,000 post offices for ensuring “anytime, anywhere and any branch banking” in these 4000 post offices. There is a financial outlay of Rs.106 crores for development of CBS software, customer relations management, training, project management unit, centralised back office etc. during the 11th Five Year Plan. The project aims at provision of delivery channels like ATM, internet, phone and mobile banking services besides streamlining the existing operations of savings schemes /savings certificates. Till now, 117 officers have been imparted CBS appreciation training and 60 operative officials have attended workshop on Core Banking.

Government has also taken the following steps to make the post offices a profitable organization:

Modernize mail operations through improved transmission of mails, parcel and logistics between major cities, setting up of automatic mail processing centres for faster processing of mails and rationalization of the existing mail network.

Induction of technology in speed post network and financial services so as to increase the efficiency of operations.

Leveraging the postal network to provide various utility services.

Utilizing technology for improving productivity in post offices.

Imparting need based training to all staff.

This information was given by the Minister of State for Communications & Information Technology, Shri Gurudas Kamat in written reply to a question in Lok Sabha today.

Dear friends,
Today orders of MACPC issued in Junagadh division of Gujarat circle and as the matter was discussed in conferrence at PTC vadodara .
19 Postmans of Division has been promoted in MACPC III and they are placed in Grade pay of 4200 from 01-09-2008.
Out of 19 postmen 4 postmen are in my 'R' Unit which are taking grade pay of 4200.
The same condition also happened in your division also.
This is the extreme injustice to IPO cadre.
More over 48 postal assistants are place in MACPC II in grade pay of 4200 out of them 12 P.A. are in my sub division and most off are SPM's.
How can we say that we are the supervisor of Postman and Postal assistants?
The department and Pay commission has done gross injustice to IP cadre.
We request GS to give justice to our cadre by approaching CAT and does not go with proposals of merger etc.. which are just time wasting and demoralizing.
The time is running very fast and if some more time gone we will be used to it and our status will be just like PRI(P) and silent target achieving machines.

'Alert citizen uses RTI to nail postal delay'

MUMBAI: Millions crib about snail mail but one aggrieved consumer used the Right To Information Act (RTI) to hold the postal department accountable for delay and to refund aggrieved customers promptly.


Thanks to Dahisar resident Kishanlal Mittal, the Secretary, Department of Posts, has been told to issue instructions to make it mandatory for every Speed Post Centre in the country to prominently display its delivery norms. The instructions came in an order by Central Information Commissioner (CIC) Deepak Sandhu on January 27, 2010.


The bureaucrat heading the postal department has also been directed to ensure that there are adequate telephone lines and manpower available to take complaints on telephone. Emails should be responded to promptly with an assurance that the complaint will be resolved in 7-10 days, says the order.


To ensure that the customer is not made to run from pillar to post for the refund, the order says that the booking centre should inform the complainant regarding his refund and ensure that he\she does not have to make multiple trips to the post office to lodge a complaint and claim refund.


Mittal's experience is that 90 % of parcels sent by Speed Post reach late and that one has to wait for six months to get a refund for delayed delivery.


He is not the only one to say that. Last year, Mahim resident Milind Mulay found out using the RTI that 27,774 Speed Post items booked from the Western suburbs of Mumbai did not reach addresses in Mumbai in time.


Last August, when an important document Mittal had sent to Kanpur by Speed Post reached four days late, he used the RTI to seek answers for questions pertaining to delivery norms of Speed Post, grievance redressal mechanism and refund in case of delayed delivery.


Since he was not satisfied by the answers he got from the central principal information officer, Mittal appealed to the first appellate authority. Here, too, he was disappointed with the reply and the matter went to the Central Information Commission, New Delhi.


On January 27, a hearing was held through video conferencing, where Mittal was represented by his son, Girish. Girish complained that Speed Post centres across the country do not display their delivery norms.


Agreeing with him, CIC Deepak Sandhu said that there is a wide gap between promise and performance when it comes to Speed Post. She noted in her order that while the customer is charged the full fees for an upgraded service, the exact nature of the service is not made transparent to him\her.


The secretary, department of posts, has been told to ensure compliance of the order in accordance with section 25(5) of the RTI Act, 2005.

The Secretary, Department of Posts, has been told by the Central Information Commissioner Deepak Sandhu to ensure compliance of her order in accordance with section 25(5) of the RTI Act, 2005. This section says: ``If it appears to the Central Information Commission or State Information Commission, as the case may be, that the practice of a public authority in relation to the exercise of its functions under this Act does not conform with the provisions or spirit of this Act, it may give to the authority a recommendation specifying the steps which ought, in its opinion, to be taken for promoting such conformity.''

Delay in filing the CAT Case
Dear friends,
The filing of CAT Case is being delayed by one week for want of the following documents :
(i) V CPC recommendation (Particularly Para 62.9 ) related to Postal Inspectors.
(ii) Govt. notification accepting the V CPC recommendation.
(iii) IV CPC recommendation (Particularly Para 10.44) related to Postal Inspectors- If possible
(iv) Govt. notification accepting the IV CPC recommendation- If possible
(v) Govt. order issued in April,2004 to increase the pay scale of Incepctor Central Excise / Income Tax from Rs.5500-175-9000 to Rs.6500-200-10500.

After dicussion with the Advoacte and verification of the Documents, it is clear that As of now, Postal Inspectors are not covered under the MOF OM dated 13.11.09, as it clearly states that, Rs.4600 GP is being given to those who were having PRE-REVISED Pay scale of Rs.6500. Postal Inspectors were upgraded to the scale of Rs.6500 as on 01.01.2006,i.e the REVISED pay scale is Rs.6500 and not the PRE-REVISED.
Hence our fight will be based on the parity with the Inspectors of CBDT/ CBEC and Assistant Grade of CSS , which was prevailing well before IV pay commission (Rs.425-700) and accepted by various pay commissions. It is the Finance Ministry, who disturbed the parity in Aptil’2004 and Nov’2009 and our Dept. also had not taken any action to set right the inequality.
In a judgement given by CAT Principal bench, New Delhi on 19.02.09 in OA No.164/2009 filed by SOs and PSs of CAT, New Delhi, it was stated that the historical parity with their counterparts in CSS/CSSS should be maintained and the Govt. was asked to pay the arrears within a period of one month. We can also fight on the same line.

Prior to the introduction of IV Central Pay Commission,
the pay scale of Inspector Post was Rs. 425-700 equivalent to that of Inspectors of Income Tax and Central Excise Departments.
The IV Central Pay Commission, taking into account all the aspects like duties and responsibilities found that there requires a parity in the scale of Inspector Posts and the Inspectors of other Departments, but however found that the Cadre of Inspector of Income Tax and Central Excise is having an element of Direct Recruitment which did not exist in the recruitment of Inspector Posts. The Department on the recommendations of the Commission accepted the same and introduced the element of direct recruitment wef 26-04-2001. The matter of up gradation of scales on par with other Departments was referred to the V Pay Commission. The V Central Pay Commission after examining the demand for up gradation of scales with that of Inspectors Income Tax/ Central Excise, recommended higher scales of 5500-175-9000 to Inspectors Posts.(Para 62.9and 62.11 of V pay commission recommendations) and hence a parity in scales with that of Inspectors of IT/Central Excise was met w.e.f. 01-01-1996. However, the scales of Inspectors Income tax and the Central Excise were further elevated to the scales of Rs. 6500-10500 from 21-04-2004 and with this, again an anomaly in scales creped in. Having the same duties and responsibilities, The Inspector of Posts was put to work on a lower scale.

Hi Permanand,

I would like to know how the meaning of pre-revised scale is interpreted as mentioned by you. Pre-revised as on 01.01.2006 means scale given at the time of implementation of 6th PC report. Pay scales (bands) recommended by 6th PC are the revised scales and anything prior to that is pre-revised.

As per the 6th PC report, we were in 6500 scale as on 01.01.2006 and only based on that we were placed in the revised scales. I think we are mis-interpreting the wordings to our disadvantage.

Please consult with the advocate once again in this regard.

Dear Mahesh,
As far as the revised pay scale in the VI CPC is concerned, kindly go through the Govt. notification accepting the VI CPC recommendation and the MOF OM dated 13.11.09.For the ASPOs, the present scale was shown as Rs.6500-10500 whereas the Revised scale was shown as Rs.7450-11500 and the corresponding Grade Pay of Rs.4600 was given in the pay band PB-2. Hence the Revised pay of ASPOs as on 01.01.06 was Rs.7450 and similarly the Revised Pay of Postal Inspector as on 01.01.06 was Rs.6500 and not the pre-revised. Initially, I also had the impression that whatever scale given in old pay scale is pre-revised only. But in the notification, it is shown as Revised and corresponding grade pay has been given.
We are going to fight any way because we had the parity with the Inspectors in CBDT / CBEC well before IV CPC.
I am thankful for your comment. Regarding past inaction,I would like to say that, we should not discuss about why no proper action was taken by the Association in 2004, when the pay scales of Inspectors in CBDT / CBEC were increased. There is no use of such discussion now. However, we should be careful not to repeat the Past inaction, this time.

Dear friends, I am not a Postal Inspector but my view is all scales of 5000,5500 and 6500 either merged or upgraded to 6500 with gp4200 as on 1-1-2006 will be eligible gp4600 vide OM dated 13-11-2009 which is a common order issued by MOF under GFR 253(2). In case any functional problem to integrate all the 3 pre-revised scales in one RR, DOP can keep separate RRs of these 3 posts in identical scale as per DOPT OM dated 24-3-2009. In CSS also identical scales can be promoted ie from PS to SO grade after fulfill eligible criteria and no problem in CSS. Since operative part of OM 13-11-2009 did not used the words 'existing scale' and 'grade pay of Rs.4200 in the pay band PB-2(S-13)'and specifically used '1-1-2006'in lieu of 'prior to 1-1-2006'there is no place for judicial misinterpretation. Besides, as mentioned in para 3 of operative part that the upgradation issued after receiving a large number of reference from pre-revised scale of Rs.6500-10500 as on 1.1.2006 not prior to 1.1.2006. I hope my friends would study such technical words and precedents before filing the case in the CAT.

4600 GP can only be granted to IPOs as there is direct rec.element.No other lower grades in DOP can be made identicle with IPOs.If IPOs/ASPOs are merged that will be different issue as the ASPOs cadre is not exists in other ministries i.e. CBDT/CSS.DOP may not give higher GP to ASPOs/SPOs.

Your intention is good. I wish you a positive decision from CAT. Please keep in mind while preparing petition for CAT that in 6th cpc importance is given for scales and not for posts.

Dear Krishna , identity is not important.Most of annonymous peoples are supporters of Permanand's move.They are waiting the time when the case is filed in CAT. I hope Permanand will do the right thing after consultation with Advocate. I have already requested him to wait for 1-2 weeks or till thje All India conference at New Delhi i.e. Ist week of April-10.We will not get justice unless we fight the case legally.

Union Minister for Communications and Information Technology A. Raja on Sunday launched the ‘My Child First’ initiative under the Rural Postal Life Insurance (RPIL) Scheme of India Post at Avinashi Post Office on 1.3.2010.
The concept is aimed at promoting the habit of investing in insurance scheme among families in rural areas for securing means to provide higher education to their children. Explaining the salient features, Mr. Raja said that the insurance cover ranging from Rs. 50,000 to Rs. 3 lakh would provide the insured with adequate funds to take care of the education of their children on its maturity after 15 years. The premium paid by the insured would go into a corpus and the entire earnings would be returned to them with bonus.
“The amount insured will thus get doubled in 15 years,” he added.
The Minister announced that Avinashi sub-post office would be given a thorough makeover both in terms of physical outlook as well as upgrading delivery of services through IT-enabled procedures under the ‘Project Arrow’ scheme of the Department of Posts before March end.

India Post as a Point of Presence (POP) for New Pension Scheme (NPS) on behalf of the Pension Fund Regulatory and Development Authority (PFRDA).

Coimbatore March 7, 2010 :Commissioner of Customs, Central Excise and Service Tax, C. Rajendiran on Saturday launched the New Pension Scheme (NPS) through India Post as a Point of Presence (POP) wherein the Head Post Offices would initially market the scheme.
Launching the scheme, Mr. Rajendiran said that post offices were a bridge between people and Government departments. The Department would play a pivotal role in every one's life. “Change is a must for growth and post offices have changed over a period both in terms of appearance as well as services”.


He exhorted the postal staff to follow a corporate culture and be a trendsetter for others to emulate and pointed out that network and identity with the people was the strength of the department.


The Postmaster General, Mr. Rajarajan, said that the Department would act as a POP for extending the new pension scheme on behalf of the Pension Fund Regulatory and Development Authority (PFRDA).


The scheme was being made available through head post offices on an experimental basis in Coimbatore region of Tamil Nadu and Southern Region of Karnataka. In the first phase, 21 head post offices in the nine districts of Western Region namely Coimbatore, R.S. Puram, Dharmapuri, Krishnagiri, Erode, Bhavani, Gobichettipalayam, Namakkal, Tiruchengode, Udhagamandalam, Coonoor, Pollachi, Udumalpet, Salem, Aatur, Suramangalam, Tirupur, Dharapuram, Mettupalayam, Tirupattur and Gudiayattam will act as POP. The department would operationalise the NPS in terms of subscriber registration for opening new pension account, acceptance of forms, verification, processing and forwarding the forms to Central Record Agency-Facilitation Centre, initial contribution processing, regular subscriber contribution upload through Meghdoot Software, subscriber servicing, grievance handling and MIS uploading.


Any Indian citizen in the age group of 18 to 55 years could join and continue till 60 years. Minimum contribution is Rs. 500 a month and Rs 6,000 per annum and there should be a minimum of four contributions. Account holders could decide on the frequency and extent of contribution across the year as per their grievance. Subscribers' contribution would be invested as per the scheme preference opted by the subscriber and options are low risk: low returns, moderate risk: moderate returns and high risk and high returns. The subscriber could opt for the options failing which the investment would be done in auto choice considering the age of the subscriber. The pension contribution would be invested in various schemes by any one of the seven pension fund managers appointed by PFRDA. The return on investments would be in the range of six to seven per cent.

Respected Madam,

Sub: Request for refixation of scale of IP as on 01-01-2006 and for granting grade pay of Rs. 4600 to the cadre of Inspector Posts.

With due respects, I would like to bring the following facts before you for favour of kind consideration.

1. In the V pay commission, the pay scales of Inspector Posts and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Services (CSS) were same i.e. Rs.5500-175-9000. Later on, the pay scales of Inspectors in CBDT / CBEC was enhanced in the scale of Rs.6500-200-10500 in April’2004 and subsequently the pay scale of Assistants in CSS was also enhanced in Sept’2006 by the concerned Departments. But the pay scale of Inspector Posts remained unchanged.
2. In this connection, I would like to cite the common order of Hon’ble CAT, Bangalore dated 27th July 2007, given in OA No. 424/06 and 211/07 filed by me and other Postal Inspectors of Karnataka Circle (Annexure-I). These OAs were filed seeking the parity in the Pay scale of Inspector Posts and Inspector of Income Tax, Central Excise, Customs etc. Since the Central Government had constituted the VI Pay Commission to set right the anomalies and to recommend Pay revision in case of Central Government employees, and the said commission had not submitted its report at that time, the Hon’ble CAT disposed of these OAs with direction to applicants and Respondents to take up the issue immediately before the VI Pay Commission for consideration with the copy of its order.
3. Regarding parity in the pay scales of Inspector of Posts and Inspector of Income Tax, it is submitted that the V CPC had recommended uniform scales for the above said post and accordingly the Inspector Post was given the pay scale on par with Inspector Income Tax w.e.f. 01.01.1996. Subsequently, during April 2004, the Inspector Income Tax was granted higher pay scales by discriminating the Inspector Post. In view of the very clear recommendation of V pay commission which were accepted and implemented by the Government, there was no discretion left on the part of Department of post to take the stand that the Post of Inspector of Income Tax and the Post of Inspector of Post are not comparable. Therefore, it was very clear that such a higher revision of scales of Inspector of Income Tax was not based on findings of V Pay commission and subsequently when the scale of Inspector of Income Tax was raised, no reason for such revision of scale for Income Inspectors was forthcoming.
4. It is an admitted fact here that the department of post had stated that no comparative study justifying the denial of higher scales to Postal Inspectors on par with Inspector of Income Tax was undertaken.
5. The demand for Parity in pay scales of Inspector Posts and Inspectors and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Service (CSS) was approved by the VI Pay commission and the commission in Para 7.6.14 of its final report, recommended the following :

“Postal Inspectors in Department of Posts have demanded a higher pay scale of Rs.6500-10500 on par with Inspectors and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Service (CSS) on the ground that they are recruited through the same examination. The Commission is recommending the merger of pre-revised pay scales of Rs.5500-9000 and Rs.6500- 10500 which will automatically bring Inspector (Posts) on par with Assistants in CSS/Inspectors and analogous posts in CBDT and CBEC. With this upgradation , Inspector (Posts) shall come to lie in an identical pay scale as that of their promotion post of Assistant Superintendent (Posts) [ASPOs]. ASPOs shall, accordingly, be placed in the next higher pay scale of Rs.7450-11500 corresponding to the revised pay band PB-2 of Rs.8700-34800 along with grade pay of Rs.4600..……… ” (Annexure-II)

The above recommendation was accepted by the Govt. Of India, and the Inspector Posts was given grade pay of Rs.4200 along with Inspectors and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Service (CSS).


But while fixing the pay scales of IPOs their pay was not brought notionally to Rs.6500 and then fixed in the revised scales recommended by VI pay commission.

For example, I was drawing salary of Rs.6025/- as on 01-01-2006 in the scale of 5500-175-9000(in the pre revised scale of V pay commission). my scale was fixed just by multiplying Rs.6025/-by 1.86 instead of taking my pay notionally as if I was drawing in the pay scales of 6500-200-10500. Therefore, I feel that the recommendations of VI pay commission to upgrade my scale as stated above was not implemented in true spirits and thus the intention of the recommendation of VI pay commission was given a goby .

Hence, I request you to kindly set right the injustice caused to me due to wrong fixation of pay though VI pay commissions recommendations were intended to mitigate the disparity between the scales of Inspectors in different departments.

6. Recently, Ministry of Finance vide OM F.No.1/1/2008-IC dated 13.11.2009, has granted the grade pay of Rs.4600 in the pay band PB-2 in revised pay structure to the posts that existed in the pre-revised scale of Rs.6500-10500 as on 01.01.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200 in the Pay band PB-2 (Annexure-III). Accordingly, the Grade Pay of Inspectors and analogous posts in CBDT/CBEC are upgraded to Rs.4600. It is to mention that Inspector Posts was brought on par with Inspectors and analogous posts in CBDT/CBEC and pre-revised pay scale of Rs.6500-10500 was given w.e.f 01.01.2006 by Govt. of India as per the recommendation of the VI pay commission. With this upgradation, ASPOs (Promotion post of Inspector Posts) was placed in the next higher pre-revised Pay scale of Rs.7450-11500, which also proves the claim that the Inspector Posts was placed in pre-revised pay scale of Rs.6500-10500 w.e.f 01.01.2006.
7. In Memo. No. 1/1/2008-IC dated 16th November 2009 of Ministry of Finance, the benefit of upgradation of grade pay Rs 4600/- has been extended to Assistants and personal Assistants of CSS, AFHQ, IFS ‘B’, and Railway Board Secretariat Service and their counterpart Stenographer Services also. The true copy of the same is attached as Annexure-IV. In para 4 of the said OM, it is stated that “ one of the reasons due to which Assistants of Central Secretariat are being granted grade pay of Rs.4600 is the fact that there is an element of direct recruitment to the post and that too through an All India Competitive Examination.” Based on this order, the concerned Departments have issued the order for upgradation. It is a fact that Inspector Posts was brought on par with Assistants in CSS by Govt. of India as per the recommendation of the VI pay commission, and the Inspector Posts has also the element of direct recruitment to the post and that too through an All India Competitive Examination conducted by the staff selection commission.
8. Also, HSG –II cadre and BCR officials who are being supervised by Inspector Posts are placed on par by placing them in grade pay Rs.4200 w.e.f 1.1.2006. The principle of supervisor should get more pay than the supervised is to be followed and the level hierarchy should be maintained by placing Inspector Posts in the grade pay of Rs.4600 and above the HSG-II and BCR officials
In view of the above facts, Inspector Posts not only qualifies but deserves to be granted the higher grade pay of Rs.4600. As Assistants in CSS, Inspectors and analogous posts in CBDT and CBEC have already been granted higher grade of Rs.4600, Inspector Posts alone is left behind. In order to keep our morale up, it is necessary to revise the grade pay of Inspector Posts to Rs.4600, otherwise I will be put to irreparable loss and injury.
Hence, it is humbly requested to look into the matter and issue necessary orders to fix the pay of Inspectors by notionally taking their pre revised scale as 6500-200-10500 as on 01-01-2006 and to fix their grade pay from Rs.4200 to Rs.4600 w.e.f 01.01.2006 immediately, as is done in respect of other Inspectors placed in CBDT and CBEC.

Merger of cadre of IPOs and ASPOs

The decision taken by the general body of Karnataka Circle association during the circle conference held on 24-01-2010, regarding merger of cadre of IPOs and ASPOs

Recently, Ministry of Finance vide OM F.No.1/1/2008-IC dated 13.11.2009, has granted the grade pay of Rs.4600 in the pay band PB-2 in revised pay structure to the posts that existed in the pre-revised scale of Rs.6500-10500 as on 01.01.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200 in the Pay band PB-2. Accordingly, the Grade Pay of Inspectors of CBDT/CBEC and analogous posts in other department except in the department of post are upgraded to Rs.4600. It is to mention that Inspector Posts was brought on par with Inspectors and analogous posts in CBDT/CBEC and pre-revised pay scale of Rs.6500-10500 was given w.e.f 01.01.2006 by Govt. of India as per the recommendation of the VI pay commission.

It is a matter of pleasure to mention here that, at last , the department of post which was earlier telling that the duties of Inspector post and Income Tax/Central Excise/CBI were not comparable and that they did not have linkage or parity, is now accepting that the grade pay of all inspectors should be same. Therefore, the Department has recommended Grade pay of Rs.4600/- to IPs, Grade pay of Rs.4800/- to ASPOs and Grade pay of Rs.5400/- to Group B Officers to maintain balance in the hierarchy.

The further developments in the above case revealed that the Finance Ministry has not agreed to the proposal made by the Department of Post, stating that the Grade of Rs.4800/- is now uniformly given to the Group B officers of all Central Ministries and if this is disturbed by granting grade pay of 5400/- to the Supdts. in the Department of post, at the entry stage itself, it would have cascading effect on other Department/Ministries. It may also be pointed out here that the cadre like ASPOs which is not an all India cadre, but a cadre, perhaps created by the department itself for accommodating senior IPOs with a promotion. Hence, it can be deemed that the cadre of IPs and ASPOs is almost equal and even the duties discharged by the officers of the cadres are almost equal . This set up is not prevailing in other central departments. Hence, in other departments, an Inspector gets promotion as Supdt., with grade pay of Rs.4800/-.

OUR SUGGESTION
Our circle proposed to suggest the following pertinent points for seeking common grade pay of Rs.4600/- for both IPs and ASPOs.
1. We can retain the identity of both IP cadre as well as ASP cadre without disturbing the status presently held.
2. There would be no harm if both IPs and ASPs are given Rs.4600/- because the duties discharged by IPs and ASPs in their capacity as appointing authorities, disciplinary authorities and as regards exercising financial powers, are on equal footing.
3. We can retain the gazetted status presently conferred on ASPs which has been given in recognition of seniority and experience in the cadre.
4. The promotion for an IP will be confined to change in status i.e. he would get gazetted status at the time of promotion into the cadre of ASPOs without extra monitory benefit.
5. This gazetted status will give a unique identity to ASPOs cadre for entrusting additional responsibilities like financial powers, passing of bills and granting of leave etc. Similarly, this will also enhance the social status of the ASPs.
6. In the accounts cadre, the AAOs and AOs had different identities with pay different pay scales in the pre-revised scale. In the sixth pay commission they have been given same grade pay retaining the original identities. The cadre of IPs and ASPOs can be retained on similar lines with the grade pay of Rs.4600/-

Technical problems which may arise, if the cadres are merged and if not bracketed.
1. Question of nomenclature : It would be very difficult to find a common nomenclature, as the senior IP promoted as ASP wants to be recognized with a unique status by virtue of his being kept in ASP cadre. Hence, common nomenclature of cadre would be unacceptable to the seniors. If the present nomenclatures are continued this will not disturb the status.
2. As is followed now, the IPs should be classified as non gazetted group B and ASPOs as Gazetted Group B. whenever an IP is promoted as ASP he will be conferred with gazetted status and his services can be utilized for managing the sensitive and responsible posts in divisional office and RO .
3. If both cadres of IPs and ASPOs are merged then the question of renaming of cadre may arise. The merged cadre cannot be named as Inspector of post because this will amount to a feeling of demotion for an ASP who is already possessing the nomenclature as ASP.
4. Further, vacancies of Inspectors of central Ministries and departments (including our department) are filled up by staff selection commission through a common notification. If the nomenclature of merged cadre of IPOs is changed as ASP or any other common name, this will have a technical problem for direct recruitment process by staff selection commission.
5. In the present set up, promotion to the cadre of ASPs from IPs is different in different circles. For example In Delhi circle an IP gets promotion to the cadre of ASPOs immediately after 3 years, where as in Karnataka circle it is more than 12 years. This will naturally cause heartburn to senior IPos. Hence, seeking common grade pay to both the cadres will mitigate this disparity and thereby, seniors will get their due hike through MACP after 10 years from the date of promotion to cadre of IP itself and not to the promotion to the cadre of ASP .

Benefits of keeping separate identities with common grade pay :
If we retain the present status of two separate cadres of IPs and ASPs with same grade pay, we can enjoy the following benefits.
1. The IPs will continue to enjoy the benefits of bonus till they are promoted as ASPos which is a gazeted status.
2. The status by virtue of service seniority can be maintained by nomenclature itself.
3. If common grade pay of Rs.4600/- is sought for, there would not be any harm for ASPs in view of introduction of MACP . As the promotion from IP to ASP will not have any change in grade pay, except gazetted status, this promotion would be ignored. Now, after 10 years of service in the IP cadre or IP and ASP put together, the officer is eligible for next grade pay of Rs.4800/- and after 20 years, officer will get grade pay of Rs.5400/-. Whereas, in the present setup the IP is getting his promotion to group B cadre after 25 years of IP service, with grade pay of mere Rs.4800/-. Hence, our demand for seeking higher grade pay of Rs.5400/- to Group B will be solved automatically. Further, the senior ASPos after getting their 5400/- can even chance to forgo their Group B promotion as this promotion involves moving away from parent circle. He can opt for retirement quietly in his comfortable zone.
4. Keeping unique identity of ASPos with gazetted status may help us to bargain for any other future benefits like special pay by virtue of their status and for bargaining further elevation in the future pay commissions.
5. At present there is no analogous post equivalent to that of ASP in CBDT/CBSE and their inspectors are getting promotion as Supdt. in the span of 08 to 12 years of service in Inspector cadre and in our department , we require 25 years to get promotion as Supdt. By elimination of separate grade pay to ASPos, we can put forth our grievance before the appropriate authority by comparing ourselves with inspector of CBDT and seek parity with them.

Conclusion
Any other proposal like merger of ASPs with P.S Gr. B does not appear to be a sound proposal as it involves functional disturbance and may create more imbalances and lead to arbitrary action by the Administration causing loss of status and also morale. Further the Officers Association also needs to be consulted and much to our agony, such a proposal would unnecessarily drag on, for an indefinite period without any fruitful result. Hence, the present proposal of merger of grade pay of IPs and ASPs with separate existence appears to be a sound proposition in the present context and the changed situation after 6th CPC. Seeking common grade pay for IPs and ASPs is the best solution in the present scenario as there would not be any technical hurdle to the department to accept this proposal as there is no question of changing nomenclature, defining and assigning duties and responsibilities for which the department and Ministry of finance may readily agree .

1. The Circle Secretary contacted Sri B R Nanajagi AD RO N K Region and discussed the issue of non reimbursement of Mobile hand set charges in spite of the orders of CPMG. The AD sir informed the CS that the officials who have requested for the mobile handset have been permitted to purchase. The members in NK Region are requested to send their request letter to RO through their DH and avail the facility before the end of the FY 2009-2010.

2. The CS contacted the GS regarding the Grade pay case of IPs. The GS informed that the upgradation of grade pay to IPs is once again sent to MOF with a DO letter of DG Posts.

The process of verification of membership of our Association is commenced. The copy of the Letter of Authorisation( Annexure II) is enclosed. It is kindly requested that the signed letter of authorization is obtained from all the members of our Association from your Division / Office and sent to me so as to reach my office on or before 20.03.2010.

As decided in the last Circle Conference, our blog (www.ipaspkarnataka.blogspot.com) is already created and being viewed by many members now. I am also happy to inform that 34 members have booked their tickets to attend All India Conference in Delhi. In this regard I have already sent a letter to CPMG to grant Spl CL to the members. The list of members is available on the blog.

Regarding upgradation of Grade pay to IPs, now the merger of IP and ASP is being heard from CHQ. A final decision has to be taken now by the CHQ. However we are endorsing the views as decided in our last Circle Conference. Our members headed by Sri Jayanth Kumar and others who approached Hon CAT Bangalore in 2006 have prepared a representation to DG Posts. A copy is available on the blog. All the IP members may send a copy of this through their proper channel.

Subsistence Allowance & Suspension

The Supreme Court has ruled that a government employee under suspension is not entitled to subsistence allowance on the basis of a revised pay scale if the disciplinary action against him or her has been taken before the revision.

A bench of Justices R V Raveendran and K S Radhakrishnan in a judgement said the suspended employee is entitled to subsistence allowance on the basis of a revised pay scale if the suspension had taken after the revision.


Interpreting rule Note 3 to Rule 7 of the Revised Pay Rules and FR 53(1)(ii)(a) and Office Memorandum dated 27th August, 1958 of the Union of India, the apex court said the rule is clear that if the revision of pay takes effect from a date prior to the date of suspension of a government servant then he/she would be entitled to benefit of increment in pay and in the subsistence allowance for the period of suspension.

"But if the revision of scale of pay takes effect from a date falling within the period of suspension then the benefit of revision of pay and the subsistence allowances will accrue to him only after reinstatement depending on the fact whether the period of suspension is treated as duty or not," Justice Radhakrishnan writing the judgement said.

The apex court passed the judgement while upholding an appeal filed by the Centre challenging the directions passed by the Central Administrative Tribunal and the Delhi High Court to pay subsistence allowance to R K Chopa, a suspended employee of the Ministry of Commerce and Industries.

Department decided to allow Lady Inspector Posts selected through Department Examinatioin and through SSC to Circles of their choice/Place of posting

Department of posts in letter No A-34013/01/2009-DE/SPB-II dated 05.02.2010 addressed to All Chief PMGs has decided to consider the requests of lady Inspectors of posts for transfer to Cirele of their choice/place of posting of their spouse with the following conditions:-

I. The transfer will be allowed under Rule 38 of P&T Volume - IV without provision of minimum service in the grade of Inspectors of Posts but subject to other conditions laid down in the said rule.

II. The CPMG of the Circle where the lady Inspectors of Posts is working would be competent to permit such transfer in consultation with the CPMG of the Circle where the transfer is sought for by the individual.

III. In order to maintain the representation of promotees and direct recruits, a surplus qualified lady candidate may be allowed to seek transfer against a vacancy meant for promotion to be filled up on the basis of Departmental Examination and a lady Inspectors of Posts appointed on the basis of Direct Recruitment may be allowed transfer against a vacancy meant to be filled up by Direct Recruitment in the Circle to which the transfer has been sought for.

IV. Further in order to maintain the representation of SC/ST/OC in the case of surplus candidates appointed by promotion on the basis of Departmental Examination and SC/ST/OBC/OC in the case of Inspectors of Posts appointed by Direct recruitment, a lady Inspectors of Posts belonging to one category may be allowed transfer against the vacant post of the same category in the desired Circle.

V. As the Department has reported 276 vacancies of Inspectors of Posts pertaining to the years 2006,2007 and 2008 to be filled by Direct Recruitment and the SSC has already taken into account the said vacancies with the reported break up for SC/ST/OBC/OC and have since declared the result of writtten part of the Combined Graduate Level Examination, these vacancies shall not be taken into consideration while entertaining requests for transfer received, if any.

Revised Norms for Postmen Establishment

Department in Memo No 9-1/2005-WSI/PE-I dated 5.2.2010 has revised the norms for Postmen establishment as follows. The revised norms will also be applicable for GDS MD as per note below Rule 106 of Volume VI Part III.

The Head of Circles and Regional PMsG are requested to undertake a review of the implementation of revised norms after six months and provide the for assessing the impact of new norms and undetaking a fresh review if considered necessary.

Note 1. Multi storied buildings denote high rise buildings with 4 or more storey

Note 2. Bulk addressee is defined as a single person or firm receiving 7 or more unregustered articles in a day. Therefore, the bulk articles as per revised definition have to be segregated and counted separately. Each bulk Addressee in receipt of 7 or more articles will be given a time factor of 2 Mts. There is no need for deduction of this workload from the total work load as is done now. To illustrate, if a particular Post Office is in receipt of 600 unregistered articles, other than bulk mail, it has to be multiplied by 0.72 and if it receives 80 articles for 7 bulk addressees then, the work for delivery of bulk mail would be 7X2 mts = 14 mts

Note 3. The norm provided at Sl no 13 is in addition to normal time factor provided for different accountable articles, In view of the introduction of this norm, separate statistics is to be maintained for accountable articles to be deliverable in high rise buildings of 4 or more storey.

Note 4.The norm provided for rendering returns by Postman of Sl No 14 is Maximum time that can be allowed per day. The individual time factors provided for return of accountable articles at Sl no 7, 9 and 13 will be applied and allowed if the workload is less than 20 mts. By application of the norms, if the workload for rendering returns works out more than 20 mts, the maximum limit of 20 mts will be applied.

Note 5. Articles delivered through Postboxes/Post bags and through window of the Post office will be excluded from the purview of delivery of unregistered articles.

Note 6. The figures of Accountable Articles should be average of six days statistics collected in the middle of the month and furnished by the incharge of delivery post office.

Note 7. The Postmaster/Sub Postmaster will furnish six days figures for unregistered mail. The verifying officer has to collect two days personal figures in the middle of week and the least of two averages will be adopted for assessing the work load.

Note 8. After having a dencity of population of 2500 per sq. km may be taken as congested area

Note 9. For postmen doing delivery of single beat system their staff hours has to be taken at 450 mts per day and doing delivery in two batches, the staff hours is to be taken as 420 mts per day.

Note 10. The number of Postman justified will be arrived at by dividing the total work load by 450 mts or 420 mts as the case may be. Additional Postman will be sanctioned if the work load is 0.5 or more.

Note 11. Distance travelled means distance covered on the main roads, lanes and bye lanes. Distance travelled covered for entering various houses is included in time factor for delivery of articles.

Income Tax Rates 2010-11 (Assessment Year 2011-12)

The income tax rate for the year 2010-2011 (Assessment year 2011-2012) announced by the Government is given below. The taxable income should be arrived after deducting maximum savings of Rs 1,00,000, HRA Exemption etc. i.e Taxable income = Gross Income - (Savings Rs 1,00,000 + HRA Exemption + HBA Interest + Rs 20,000 for infrastructure bonds)

In case of individual (other than II and III below) and HUF

II. In case of individual being a woman resident in India and below the age of 65 years at any time during the previous year:-

III. In case of an individual resident who is of the age of 65 years or more at any time during the previous year:-

iv. Where the total income exceeds Rs.8,00,000/- Rs.86,000/- + 30% of the amount by which the total income exceeds Rs.8,00,000/-.

Surcharge: The surcharge on Income Tax for Individuals for total income exceeding Rs.10 lacs stands removed.

Education Cess: 3% of the Income-tax.

Chief Post Master General of Maharashtra and Goa M.S. Bali has been caught while accepting a Rs.2-crore bribe

Mumbai, Feb 25 (IANS) Chief Post Master General of Maharashtra and Goa M.S. Bali has been caught while accepting a Rs.2-crore bribe, the Central Bureau of Investigation (CBI) said Thursday, describing it as the biggest such case involving a government official in 60 years. He has been sent to a week's CBI custody.
Investigators who nabbed Bali Wednesday night while taking the bribe for giving a no-objection certificate (NOC) for a property deal also recovered Rs.34 lakh in cash from his south Mumbai residence, and over $10,000 as well as British pound 3,050 and euros 3,470, packed in four suitcases.
"This is the biggest single case of a bribe involving a senior government servant in the last 60 years," CBI Western Region Director Rishi Raj Singh told reporters.
Bali was brought before the special CBI judge S.P. Hayatnagarkar, who remanded him in CBI custody till March 3, along with two accomplices, Harsh Dalmiya and his father Arun Dalmiya.
A 1970 Indian Postal Service officer holding the rank of additional secretary in the central government, Bali also owns two expensive cars, a bank locker in Gwalior and 45 bottles of imported liquor.
The CBI, Singh said, was making arrangements to open the locker and check its contents.
Besides this, Bali also owns large properties in Faridkot, Panchkhula, Dwarka, New Delhi, Bhopal and Gurgaon, totally worth over Rs.1 crore.
He also has 22 accounts in different banks and Public Provident Fund accounts with a total of more than Rs. 26 lakh deposited in them. The CBI sleuths also recovered 7 high-end laptops, totally worth around Rs.5 lakh, Singh said.
Bali had demanded the Rs.2 crore bribe in return for granting an NOC to develop a plot of land belonging to a private builder in the Mira Road suburb of Thane district, he said.
Relating the events leading to Bali's arrest, Singh said the government wanted to construct a post office on the land.
"The property owner offered to develop the property and also give 25 percent of it for the post office. For this, an NOC was required from the CPMG (chief post master general)," he said.
Meanwhile, the Thane civic authorities were also writing to the postal authorities to expedite the proposal for the new post office. Former corporator Rita Shah, who is the complainant in the case, was also pursuing the matter and met Bali in his office and submitted the documents for getting an NOC.
Shah was then approached by a man called Harish Dalmiya, who ran a consultancy firm in Nariman Point and asked her to meet him in connection with the pending NOC.
When she went to meet him, she was surprised to find all the papers she had submitted to the CPMG in Dalmiya's office.
"Dalmiya assured her that the NOC work would be done in return for a bribe of Rs.2 crore," Singh said, adding Shah approached the CBI to lodge a complaint and the investigating agency then set a trap for Bali.
Meanwhile, Shah was taken by Dalmiya to meet Bali where he said that the work would be done in consideration of Rs.2 crore and asked her to hand over the money to Dalmiya at his office. When she did, he issued her the NOC.
Bali came to collect the money from Dalmiya and Shah Wednesday at Moshe Restaurant in Colaba only to find CBI sleuths lying in wait for him. He was arrested and Rs.1.25 crore, purported to be his share of the deal, seized from him. The remaining amount was probably the Dalmiyas' share.
Shah declined to comment on the matter. "Since it involved such a senior central government officer, I thought it must be brought to the notice of an agency like the CBI," was all she said, when approached by media persons.
Meanwhile, CBI raids are continuing at Bali's official residence in Belvedere Apartments in the posh Pedder Road are of south Mumbai, the residences of the Dalmiyas, and Bali's other properties and bank accounts.

Respected Madam,

Sub: Request for refixation of scale of IP as on 01-01-2006 and for granting grade pay of Rs. 4600 to the cadre of Inspector Posts.

With due respects, I would like to bring the following facts before you for favour of kind consideration.

1. In the V pay commission, the pay scales of Inspector Posts and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Services (CSS) were same i.e. Rs.5500-175-9000. Later on, the pay scales of Inspectors in CBDT / CBEC was enhanced in the scale of Rs.6500-200-10500 in April’2004 and subsequently the pay scale of Assistants in CSS was also enhanced in Sept’2006 by the concerned Departments. But the pay scale of Inspector Posts remained unchanged.

2. In this connection, I would like to cite the common order of Hon’ble CAT, Bangalore dated 27th July 2007, given in OA No. 424/06 and 211/07 filed by me and other Postal Inspectors of Karnataka Circle (Annexure-I). These OAs were filed seeking the parity in the Pay scale of Inspector Posts and Inspector of Income Tax, Central Excise, Customs etc. Since the Central Government had constituted the VI Pay Commission to set right the anomalies and to recommend Pay revision in case of Central Government employees, and the said commission had not submitted its report at that time, the Hon’ble CAT disposed of these OAs with direction to applicants and Respondents to take up the issue immediately before the VI Pay Commission for consideration with the copy of its order.

3. Regarding parity in the pay scales of Inspector of Posts and Inspector of Income Tax, it is submitted that the V CPC had recommended uniform scales for the above said post and accordingly the Inspector Post was given the pay scale on par with Inspector Income Tax w.e.f. 01.01.1996. Subsequently, during April 2004, the Inspector Income Tax was granted higher pay scales by discriminating the Inspector Post. In view of the very clear recommendation of V pay commission which were accepted and implemented by the Government, there was no discretion left on the part of Department of post to take the stand that the Post of Inspector of Income Tax and the Post of Inspector of Post are not comparable. Therefore, it was very clear that such a higher revision of scales of Inspector of Income Tax was not based on findings of V Pay commission and subsequently when the scale of Inspector of Income Tax was raised, no reason for such revision of scale for Income Tax Inspectors was forthcoming.

4. It is an admitted fact here that the department of post had stated that no comparative study justifying the denial of higher scales to Postal Inspectors on par with Inspector of Income Tax was undertaken.

5. The demand for Parity in pay scales of Inspector Posts and Inspectors and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Service (CSS) was approved by the VI Pay commission and the commission in Para 7.6.14 of its final report, recommended the following :

“Postal Inspectors in Department of Posts have demanded a higher pay scale of Rs.6500-10500 on par with Inspectors and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Service (CSS) on the ground that they are recruited through the same examination. The Commission is recommending the merger of pre-revised pay scales of Rs.5500-9000 and Rs.6500- 10500 which will automatically bring Inspector (Posts) on par with Assistants in CSS/Inspectors and analogous posts in CBDT and CBEC. With this upgradation , Inspector (Posts) shall come to lie in an identical pay scale as that of their promotion post of Assistant Superintendent (Posts) [ASPOs]. ASPOs shall, accordingly, be placed in the next higher pay scale of Rs.7450-11500 corresponding to the revised pay band PB-2 of Rs.8700-34800 along with grade pay of Rs.4600..……… ” (Annexure-II)

The above recommendation was accepted by the Govt. Of India, and the Inspector Posts was given grade pay of Rs.4200 along with Inspectors and analogous posts in CBDT/CBEC as well as Assistants of Central Secretariat Service (CSS).


But while fixing the pay scales of IPOs their pay was not brought notionally to Rs.6500 and then fixed in the revised scales recommended by VI pay commission.

For example, I was drawing salary of Rs.6025/- as on 01-01-2006 in the scale of 5500-175-9000(in the pre revised scale of V pay commission). my scale was fixed just by multiplying Rs.6025/-by 1.86 instead of taking my pay notionally as if I was drawing in the pay scales of 6500-200-10500. Therefore, I feel that the recommendations of VI pay commission to upgrade my scale as stated above was not implemented in true spirits and thus the intention of the recommendation of VI pay commission was given a goby .

Hence, I request you to kindly set right the injustice caused to me due to wrong fixation of pay though VI pay commissions recommendations were intended to mitigate the disparity between the scales of Inspectors in different departments.


6. Recently, Ministry of Finance vide OM F.No.1/1/2008-IC dated 13.11.2009, has granted the grade pay of Rs.4600 in the pay band PB-2 in revised pay structure to the posts that existed in the pre-revised scale of Rs.6500-10500 as on 01.01.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200 in the Pay band PB-2 (Annexure-III). Accordingly, the Grade Pay of Inspectors and analogous posts in CBDT/CBEC are upgraded to Rs.4600. It is to mention that Inspector Posts was brought on par with Inspectors and analogous posts in CBDT/CBEC and pre-revised pay scale of Rs.6500-10500 was given w.e.f 01.01.2006 by Govt. of India as per the recommendation of the VI pay commission. With this upgradation, ASPOs (Promotion post of Inspector Posts) was placed in the next higher pre-revised Pay scale of Rs.7450-11500, which also proves the claim that the Inspector Posts was placed in pre-revised pay scale of Rs.6500-10500 w.e.f 01.01.2006.

7. In Memo. No. 1/1/2008-IC dated 16th November 2009 of Ministry of Finance, the benefit of upgradation of grade pay Rs 4600/- has been extended to Assistants and personal Assistants of CSS, AFHQ, IFS ‘B’, and Railway Board Secretariat Service and their counterpart Stenographer Services also. The true copy of the same is attached as Annexure-IV. In para 4 of the said OM, it is stated that “ one of the reasons due to which Assistants of Central Secretariat are being granted grade pay of Rs.4600 is the fact that there is an element of direct recruitment to the post and that too through an All India Competitive Examination.” Based on this order, the concerned Departments have issued the order for upgradation. It is a fact that Inspector Posts was brought on par with Assistants in CSS by Govt. of India as per the recommendation of the VI pay commission, and the Inspector Posts has also the element of direct recruitment to the post and that too through an All India Competitive Examination conducted by the Staff Selection Commission.



8. Also, HSG –II cadre and BCR officials who are being supervised by Inspector Posts are placed on par by placing them in grade pay Rs.4200 w.e.f 1.1.2006. The principle of supervisor should get more pay than the supervised is to be followed and the level hierarchy should be maintained by placing Inspector Posts in the grade pay of Rs.4600 and above the HSG-II and BCR officials

In view of the above facts, Inspector Posts not only qualifies but deserves to be granted the higher grade pay of Rs.4600. As Assistants in CSS, Inspectors and analogous posts in CBDT and CBEC have already been granted higher grade of Rs.4600, Inspector Posts alone is left behind. In order to keep our morale up, it is necessary to revise the grade pay of Inspector Posts to Rs.4600; otherwise I will be put to irreparable loss and injury.

Hence, it is humbly requested to look into the matter and issue necessary orders to fix the pay of Inspectors by notionally taking their pre revised scale as 6500-200-10500 as on 01-01-2006 and to fix their grade pay from Rs.4200 to Rs.4600 wef 01.01.2006 immediately, as is done in respect of other Inspectors placed in CBDT and CBEC.

Sub: Up-gradation of Grade Pay of Inspector Posts and merger proposal of the posts of IP&ASP

1. I have been regularly informing you of the developments that have been taking place in the matter relating to settlement of Pay commission anomalies relating to our pay structure.

2. As you are aware, a proposal for grant of higher grade pay of Rs 4600/- to IPOs, Rs 4800 to ASPs and Rs 5400 to PS Gr. B was forwarded by Dept. of Posts to Ministry of Finance for approval recently. It is learnt that the Ministry of Finance has since returned the file with the observations that Inspector (Posts) can not be compared with the post of Assistant of CSS/Inspectors and analogous posts in CBDT/CBEC. Only PS Gr. B posts in the Dept. of Posts are comparable to those of Gr. B posts in CSS,CBDT/CBEC and therefore the proposal for upgradation of grade pay of Inspector (Posts) from Rs 4200 to Rs 4600/- is not feasible.

3. This particular anomaly has arisen only due to upgradation of Grade pay of Inspectors in CBDT/CBEC and that of Assistants in CSS subsequent to the implementation of the recommendations of 6th Pay Commission.

4. This type of upgradation happened last time also and our demand was kept in parity with Inspectors of CBDT/CBEC. This was recognized by the 6th Pay Commission and accordingly the Inspector (Posts) got placement on par with Inspectors CBDT/CBEC. But once again the Grade pay of Inspectors CBDT/CBEC has been revised upwardly after the implementation of 6th CPC, thus giving rise to this anomaly.

5. Though there is every justification for keeping parity as recommended by the sixth CPC and accepted by the Govt. it does not appear to be inclined to accept our demand nor does the Dept. of Posts appear to feel convinced to correct the anomaly exerting due pressure on the Finance Ministry. This situation has arisen because; there is no analogous post equivalent to that of ASP in CBDT/CBEC.

6. If at all the parity can be restored, the Department would be forced to consider the question merger of Inspector Posts and Assistant Supdt. Posts into a common cadre preferably with a single nomenclature “Assistant Superintendent Posts” with uniform higher grade pay of Rs 4600/-. However any fresh proposal ought to take into consideration the fact that such a change would not cause functional disturbance. As on date there is practically no difference in the nature of work performed by the IPs and ASPs. Viewed in this context, merger of IPs and ASPs appears to be one that does not affect functional disturbance. The Department appears to be inclined to grant Gazetted status to all ASPs in the upgraded post.

7. This proposal obviously entails some loss to the cadre which can be enumerated as follows:
a) Loss of promotional post of ASP – But this loss is would be offset by the recent MACPs.
b) Loss of Bonus to present Inspector Posts.

8. Any other proposal like merger of ASPs with P.S Gr. B does appear to be a sound proposal as it involves functional disturbance and may create more imbalances and lead to arbitrary action by the Administration causing loss of status and also morale. Further the Officers Association also needs to be consulted and much to our agony, such a proposal would unnecessarily drag on for an indefinite period without any fruitful result. Hence the present proposal of merger of IPs and ASPs appears to be a sound proposition in the present context and the changed situation after 6th CPC.

9. We are therefore at a crucial stage and the Department expects us to take a decisive course at the earliest so that the Department can formulate a proposal to that effect. I have met DG (Posts) on 17.02.10 and requested her to solve the anomaly at the earliest taking appropriate steps. I have met other officers who are dealing this subject in the Dte. and MOF also on 17 & 18.2.10 and discussed this issue.

10. Since the present move is likely to have long range impact on our cadre, it would be in the true interest of all the members, if a unanimous decision is taken in this regard and therefore can not be left to the decisions of individuals.

11. The next All India Conference of our Association is to be held during April 2010, It would therefore be more appropriate to take a final decision in this regard in the Conference. Before that it is necessary that a decision is taken by Circle Associations either in the Conference that may be held before the next AIC or by convening a special General Body meeting or at least by convening a special CWC by all Circle branches.

12. Since we are required to respond at the earliest, all are requested to come prepared to the next AIC with a firm resolution from the Circle Association so that the discussions on this subject prove to be conclusive in the next AIC. If all Circles are unanimous in their decision and the GS authorized to proceed further with the merger issue, I will act accordingly before the AIC. You are requested to send the decision of your Circle Branch in writing.
